Executive Summary:

Court Clerks

• In FY23, Court Clerks assessed $351.2M and collected $199.7M in fines and fees.
• Court assessments between FY22 and FY23 increased by $19.4M.
• Collections by Court Clerks between FY22 and FY23 decreased by $10.9M.

Commonwealth’s Attorneys

• In FY23, total assessments(*1) of delinquent fines and fees were $156.7M.
• Assessments of delinquent restitution amounts sent to collections were $35.8M.
• Net assessments(*2) of delinquent fines and fees were $70.9M.
• Net assessments(*2) of delinquent fines and fees between FY22 and FY23 increased by $0.7M.
• Total collections(*3) of delinquent fines and fees by Commonwealth’s Attorneys were $55.3M.
• Restitution collections in FY23 totaled $7.2M, and collections of fee offset amounts totaled $6.7M.
• Net collections(*4) by Commonwealth’s Attorneys in FY23 were $58.8M.
• Net collections(*4) by Commonwealth’s Attorneys between FY22 and FY23 increased by $8.2M.

• $297.4M in FY18; and

Commonwealth’s Attorneys

• Commonwealth’s Attorneys’ net assessments(*1) were:

• $95.5M in FY98;
• $186.6M in FY18; and
• $70.9M in FY23.

• Commonwealth’s Attorneys’ total collections(*2) were:

• $29.2M in FY98;
• $67.0M in FY18; and
• $55.3M in FY23.

• Commonwealth’s Attorneys’ net collections(*3) were:

• $23.0M in FY98;
• $65.7M in FY18; and
• $58.8M in FY23.

(*2) Total collections exclude both restitution and offset fee amounts collected for all years.

Collection Agents

• In FY23, Commonwealth’s Attorneys contracted with seven private collection agents, six localities and one state agency for the collection of delinquent fines and fees.
• Collection fee percentages ranged from 17 percent to 35 percent.
